The website www.edicadsmart.fr, hereinafter referred to as the “Website” is the exclusive property of the EDICAD company, which designed it, edits and updates its content.
PREAMBLE
Consultation of the www.edicadsmart.fr website is subject to full acceptance and compliance with these General Terms and Conditions of Use by the Internet user hereinafter referred to as “the User”. Access to the Website constitutes full and complete acceptance by the User of these conditions.
The User undertakes to make personal and non-commercial use of the information contained on the Website. Failure by the User to comply with the provisions of these General Conditions of Use may result in civil and/or criminal liability.
This Contract is concluded for an indefinite period. Its effect with regard to the User occurs from the beginning of the use of the Website.
EDICAD reserves the right to modify at any time, without notice, all or part of the provisions of this Contract. These changes will be effective as soon as they are published on the Website.
Use of the Website implies full recognition and acceptance of the terms of this Contract, which binds the User to EDICAD. If the User refuses to accept this Contract and its amendments, it is the User’s responsibility not to use or access the Website.
1. SUBJECT
The purpose of these General Terms and Conditions of Use is to set out the terms and conditions for the provision, access and use of the Website.
2. ENTRY REQUIREMENTS
The User acknowledges having the means and skills necessary to use the Website. The equipment necessary to access and use the Website is at the expense of the User, as are the telecommunication costs incurred by their use.
3. WEBSITE CONTENT
The EDICAD Website presents to Internet users Products exclusively intended for building professionals. These Products, without their list being exhaustive, are :
- Softwares and patches
- Services: After Sales Service (remote maintenance); Services Pack; software trainings
4. COPYRIGHT PROTECTION
The various Products presented are offered for sale, in particular to any architectural firm, project management company, design office (economists, engineers), construction company or any other professional working in any trade whatsoever in the Construction industry.
In addition, the Website provides a news feed fed by EDICAD news. All the links presented on the Website may contain trademarks, logos, designs and other models belonging to third parties. Any User dissatisfied with any information published on the Website is invited to contact EDICAD directly by email or by post.
The Products, the Website, including the technical documents, photographs, texts, logos, drawings and videos that make it up and that are covered by these General Conditions of Use, are the exclusive property of EDICAD.
5. PRIVACY PROTECTION
The User may be asked to provide certain personal data by answering the forms that are proposed to him/her. Entering this data means that it will be processed by EDICAD in order to respond to the User’s request.
EDICAD undertakes to comply with the provisions of the European General Data Protection Regulation (GDPR, May 2018) relating to computers, files and freedoms, and to take all necessary precautions to preserve the security of the personal information entrusted to it. Regardless of the information communicated internally and to the distribution network that markets EDICAD’s Products, and unless the User has given prior and informed written authorisation, personal data is not given, exchanged, rented or sold to third parties for the purposes of their own business.
The personal data thus collected is used within the EDICAD company and may be transmitted to third parties, such as EDICAD’s partner companies, companies specialising in the processing of this data and the independent distribution network marketing EDICAD’s products and services in France and abroad, if the processing induced by the User’s request so requires.
EDICAD cannot be held responsible for the use of the User’s personal data by these third parties. EDICAD shall not be held liable for the use of information concerning the User disclosed by the User when using the Website and/or EDICAD’s services.
This data is stored on secure servers.
User may at any time exercise his/her right to access, correction, removal, portability or opposition to the personal information he/she provides to EDICAD via the online forms on its Website. These rights may be exercised, in accordance with the regulations, by simple request by e-mail to info@edicad.com, or by post to EDICAD’s registered office address (see below), providing proof of identity and a legitimate reason as provided for by the regulations.
6. COOKIES
The EDICAD Website may use cookies. Cookies are text files deposited on the User’s hard disk when visiting commercial sites. Cookies can be collected, read and recorded by the server that issued them. They are recorded by means of a random number and can in no way identify the User. These cookies inform the web server of the content of the visit made by the User (viewed pages, spent time, clicked links, etc.) and help to make browsing easier and more comfortable during subsequent visits. EDICAD may use automatic data collection tools for the following purposes :
- Use of the Website : in order to help EDICAD to recognise the browser used by the User, to record the preferences defined by the User during his/her previous visit to the Website;
- Social networks : to check if the User is connected to third party services (Facebook, Twitter, LinkedIn, Google+…);
- Targeting : to enable EDICAD to know the type and language of the browser used, the address of the site through which the User accesses the EDICAD Website (browsing path), its IP address (internet protocol), the date and time of the visit, etc., in order to communicate a posteriori or in real time and in a more relevant way with him by emailings, newsletters, database enrichment… ;
- Audience measurement : to enable EDICAD to monitor statistical data on the frequentation of its Website, either to know the use made of said Website by visitors; or to improve the services of said Website, to help measure and study the effectiveness of its content, characteristics, advertising and other forms of communication.

- The retention period for this information is 60 days from the subscription date. The User may nevertheless oppose the recording of cookies by configuring the browser he or she uses, according to the procedures and parameters specific to the latter.
7. RESPONSIBILITIES
EDICAD declines all responsibility for any malfunctions that may occur on the Website and lead to loss of data or unavailability of access to information produced on it. The elements presented on the Website are subject to change without notice and are made available to the User, without any guarantee of any kind, express or tacit.
The hypertext links present on the Website do not create any solidarity of responsibility between them and the owners of other sites, in particular with regard to the content of the latter to which the User may be redirected.
EDICAD cannot guarantee the completeness and truthfulness of the information on its Website. Similarly, it cannot guarantee the absence of malicious modification by a third party like, for example, a viral intrusion.
The User is held solely responsible for the use he/she makes of the content of the Website. Except in the case of serious misconduct on the part of EDICAD, the latter cannot be held liable for direct and indirect damage related to the use of the information presented on its Website.
8. GENERAL PROVISIONS
No indication or document may give rise to an obligation not included in these General Terms of Use unless it is the subject of a new express agreement between EDICAD and the User. The fact that EDICAD or the User has not demanded the application of any clause of these General Terms of Use, whether permanently or temporarily, may in no way be considered as a waiver of the said clause. In the event of difficulty of interpretation between any of the headings appearing at the head of the clauses and any of the clauses, the headings will be declared non-existent.
9. APPLICABLE LAW AND DISPUTE RESOLUTION
The present Terms and Conditions of Use are governed by French law. In the event of a dispute, only the French courts shall have jurisdiction.
